1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User,"
"you," or "your") and DTF Town ("Company," "we," "us," or "our")
, regarding your access to and
use of the www.dtftown.com website as well as any other media form, media channel, mobile
website, or mobile application related, linked, or otherwise connected thereto (collectively, the
"Site").
By accessing or using the Site, purchasing products, or using our services, you agree that you
have read, understood, and agree to be bound by all of these Terms. If you do not agree with all
of these Terms, then you are expressly prohibited from using the Site and must discontinue
use immediately.
You must be at least 18 years of age to use this Site. By using this Site and by agreeing to
these Terms and Conditions, you warrant and represent that you are at least 18 years of age.
2. Use of Website & Eligibility
To access certain features of the Site, you may be required to register for an account. You
agree to keep your password confidential and will be responsible for all use of your account
and password. We reserve the right to remove, reclaim, or change a username you select if we
determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise
objectionable.
You agree to provide accurate, current, and complete information during the registration
process and to update such information to keep it accurate, current, and complete.
3. Products & Services
DTF Town specializes in Direct-to-Film (DTF) transfers, custom apparel printing, and blank
apparel wholesale.
DTF Transfers: We offer both ready-to-press designs and custom DTF transfer services.
Custom Orders: Users may upload their own designs for printing. It is the user's
responsibility to ensure files meet our submission guidelines.
Blank Apparel: We sell blank garments suitable for DTF application.Heat Press Services: We offer complimentary heat press services at our physical locations
in Fairfax, VA, and Orlando, FL, subject to availability and store policies.
We make every effort to display as accurately as possible the colors, features, specifications,
and details of the products available on the Site. However, we do not guarantee that the colors,
features, specifications, and details of the products will be accurate, complete, reliable, current,
or free of other errors, and your electronic display may not accurately reflect the actual colors
and details of the products.
4. Ordering & Payment
By placing an order through the Site, you are making a binding offer to purchase the products
selected. We reserve the right to accept or reject any order in our sole discretion.
Pricing: All prices are subject to change without notice. We reserve the right to discontinue any
product at any time.
Payment: We accept major credit cards and other payment methods as indicated on the Site.
You agree to provide current, complete, and accurate purchase and account information for all
purchases made via the Site. Sales tax will be added to the price of purchases as deemed
required by us.
Modifications: Once an order is placed, it immediately enters our processing system.
Modifications or cancellations may only be possible if the order has not yet entered the
production phase. We cannot guarantee that changes can be made after an order is
submitted.
5. Custom Orders & Artwork Policy
Responsibility: You are solely responsible for the quality, resolution, and content of the artwork
you submit. We are not responsible for poor print quality resulting from low-resolution files
provided by you.
Copyright Warranty: By submitting artwork, you warrant and represent that you own all rights
to the artwork or have obtained the necessary licenses and permissions to use and reproduce
the artwork. You agree not to submit any material that infringes on the intellectual property
rights, rights of publicity, or privacy of any third party.
Right to Refuse: DTF Town reserves the right to refuse to print any design that we, in our sole
discretion, deem illegal, hateful, obscene, defamatory, or otherwise objectionable, or that
appears to infringe on third-party intellectual property rights.Color Disclaimer: Please note that colors on a computer screen (RGB) may look different when
printed (CMYK). We do not guarantee 100% color matching unless a specific Pantone color
match service is purchased and agreed upon in writing.
No Refunds on Custom Work: Due to the personalized nature of custom DTF transfers, all
custom orders are final and non-refundable once production has begun.
6. Shipping & Delivery
Processing Time: Standard processing times are 1-2 business days for custom orders, though
this may vary based on volume. "Same Day" shipping applies only to orders placed before our
specified cutoff times and is not a guarantee of delivery date.
Carriers: We utilize third-party carriers (such as USPS, UPS, FedEx) for shipping. Shipping
costs are calculated at checkout.
Risk of Loss: All items purchased from the Site are made pursuant to a shipment contract.
This means that the risk of loss and title for such items pass to you upon our delivery to the
carrier.
Delays: Delivery dates are estimates only and are not guaranteed. DTF Town is not liable for
delays caused by the carrier, weather, or other factors beyond our control.
Address Accuracy: You are responsible for providing a correct and complete shipping address.
We are not responsible for packages delivered to an incorrect address provided by the
customer.
7. Returns, Refunds & Exchanges
Custom Orders: CUSTOM ORDERS ARE FINAL SALE. We do not accept returns or exchanges
on custom printed transfers unless the product is defective due to our error (e.g., wrong size
sent, significant print error).
Defective Products: If you receive a defective product, you must contact us at
support@dtftown.com within 48 hours of delivery. You must provide photographic evidence of
the defect. If we verify the defect, we will reproduce the order or provide a refund at our
discretion.
Ready-to-Press/Blank Items: Unused, unopened non-custom items may be returned within 14
days of delivery. A restocking fee may apply. The customer is responsible for return shipping
costs unless the return is due to our error.
Shipping Costs: Shipping costs are non-refundable.
8. Intellectual PropertyUnless otherwise indicated, the Site is our proprietary property and all source code, databases,
functionality, software, website designs, audio, video, text, photographs, and graphics on the
Site (collectively, the "Content") and the trademarks, service marks, and logos contained
therein (the "Marks") are owned or controlled by us or licensed to us.
User License: By submitting artwork to DTF Town for printing, you grant us a non-exclusive,
royalty-free, worldwide license to use, reproduce, modify, and display the artwork solely for the
purpose of fulfilling your order and producing the requested products.
DMCA: We respect the intellectual property rights of others. If you believe that any material
available on or through the Site infringes upon any copyright you own or control, please
immediately notify us using the contact information provided below.
9. Prohibited Uses
You may not access or use the Site for any purpose other than that for which we make the Site
available. Prohibited activities include, but are not limited to:
Systematically retrieving data or other content from the Site to create or compile, directly or
indirectly, a collection, compilation, database, or directory without written permission from
us.
Making any unauthorized use of the Site, including collecting usernames and/or email
addresses of users by electronic or other means for the purpose of sending unsolicited
email.
Using the Site to advertise or offer to sell goods and services without our express written
consent.
Harassing, annoying, intimidating, or threatening any of our employees or agents engaged in
providing any portion of the Site to you.
Uploading or transmitting viruses, Trojan horses, or other material that interferes with any
party’s uninterrupted use and enjoyment of the Site.
10. Phone & SMS Communications
Consent to Contact: By providing your phone number to DTF Town (whether during checkout,
account creation, or inquiry forms)
, you expressly consent to receive voice calls and text (SMS)
messages from us at the number provided. This consent includes communications related to:
Order confirmations and status updates
Shipping and delivery notifications
Customer service inquiries and supportMarketing and promotional offers (if opted in)
Call Recording: You acknowledge and agree that telephone calls between you and DTF Town
representatives may be monitored and recorded for quality assurance, training, and dispute
resolution purposes.
Opt-Out: You may opt out of receiving marketing text messages at any time by replying "STOP"
to any message you receive from us. You may also contact us at support@dtftown.com to
request removal from our calling lists.
Costs: Message and data rates may apply for any SMS messages sent to you from us and to
us from you.

11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DTF TOWN, ITS
DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY
DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE
DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES
ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF WE HAVE BEEN
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO
YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL
AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SPECIFIC
ORDER GIVING RISE TO THE CLAIM.
WE ARE NOT RESPONSIBLE FOR ANY DELAYS IN PRODUCTION OR SHIPPING, NOR FOR ANY
DAMAGES RESULTING FROM THE USE OR MISUSE OF OUR PRODUCTS.
12. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS
AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE
AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL
WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE
THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and
all of our respective officers, agents, partners, and employees, from and against any loss,damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made
by any third party due to or arising out of: (1) your submitted artwork or content; (2) use of the
Site; (3) breach of these Terms; (4) your violation of the rights of a third party, including but not
limited to intellectual property rights; or (5) any overt harmful act toward any other user of the
Site.
14. Governing Law
These Terms and your use of the Site are governed by and construed in accordance with the
laws of the Commonwealth of Virginia, USA, without regard to its conflict of law principles. You
agree that any legal action or proceeding between you and DTF Town shall be brought
exclusively in the state or federal courts located in Fairfax County, Virginia.
15. Dispute Resolution / Arbitration
Informal Resolution: To expedite resolution and control the cost of any dispute, controversy, or
claim related to these Terms (each "Dispute" and collectively, the "Disputes")
, you and we agree
to first attempt to negotiate any Dispute (except those Disputes expressly provided below)
informally for at least thirty (30) days before initiating arbitration.
Binding Arbitration: If the parties are unable to resolve a Dispute through informal
negotiations, the Dispute (except those Disputes expressly excluded below) will be finally and
exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS
PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.
Class Action Waiver: The parties agree that any arbitration shall be limited to the Dispute
between the parties individually. To the full extent permitted by law, (a) no arbitration shall be
joined with any other proceeding; (b) there is no right or authority for any Dispute to be
arbitrated on a class-action basis or to utilize class action procedures.
16. Severability & Waiver
If any provision or part of a provision of these Terms is determined to be unlawful, void, or
unenforceable, that provision or part of the provision is deemed severable from these Terms
and does not affect the validity and enforceability of any remaining provisions. A failure by us
to enforce any right or provision of these Terms will not be considered a waiver of those rights.
17. Changes to Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms
at any time and for any reason. We will alert you about any changes by updating the "LastUpdated" date of these Terms, and you waive any right to receive specific notice of each such
change. It is your responsibility to periodically review these Terms to stay informed of updates.
